How is this Possible?
Under the Telephone Consumer Protection Act (TCPA) individuals must provide express consent to receive certain types of calls. Individuals also have the right to tell these companies, including debt collectors, to stop calling. At the beginning of the call, there are numerous steps that must be taken by the caller. The caller must provide an option to opt-out of the calls. They must also identify who they are as well as what company they are calling from, including the businesses address and phone number. The TCPA penalizes businesses that are in violation of the act, meaning you may be entitled.
What is a Robocall?
Robocalls are calls placed by using automatic dialing technology which allows companies to place mass phone calls. Companies then affix a pre-recorded message to the call, allowing them to implement a screening process to heighten their chances of “converting” a call. Once the automatic dialer is connected on the phone-line with its target, the pre-recorded message makes a solicitation and prompts you to press a number to speak with a live agent.
The law specially prohibits companies from using autodialers or “robocallers.” Additionally, a National Do Not Call Registry has been created that prohibits these callers from contacting you at all! Many of these companies do not care about the law and will continue calling and harassing until you force them to stop by filing a lawsuit.
