What is Medical Malpractice?

Medical malpractice is the term that is used to describe negligence caused by a medical professional while rendering services. When an injury is caused by a healthcare professional who has deviated from the typical standard of care expected in their profession, they can be held liable for medical malpractice. It can involve a multitude of medical professionals, including, but not limited to: doctors, nurses, anesthesiologists, surgeons, pharmacists, dentists, radiologists, and physical therapists.

How much is my case worth?

Our clients almost always ask how much we think their cases are worth. Each case is unique and it is extremely difficult to place a dollar amount on your case. However, according to the Indiana Department of Insurance, in 2016, the average payout for successfully brought medical malpractice cases was $729,602.08. Bear in mind that Indiana places a cap on the total amount of money that can be recovered on cases stemming from medical malpractice. For cases accruing from July 1, 2017, through June 30, 2019, there is a cap of $1.65 million dollars. As of July 1, 2019, for claims arising on or after July 1, 2019, the cap increased to $1.8 million dollars.

What is the process to bring a medical malpractice claim?

To bring a medical malpractice claim in Indiana, we start by filing what is called a proposed complaint with the Indiana Department of Insurance. After filing the complaint, we will begin the process of proving your case through written and live discovery. Once we believe your claim has been sufficiently substantiated, a medical malpractice review panel will convene and conduct an independent inquiry into the patient’s standard of care. Once the evidence is examined by the panel, they will issue an opinion as to whether the evidence supports a conclusion that the healthcare provider(s) complied with the appropriate standard of care. After the panel renders its opinion, we will pursue compensation in state court by filing a complaint in the jurisdiction which the events occurred.
